Robert Vadra DLF land grab scam case The Robert Vadra DLF land grab scam is a case related to 50-acre land grab in 2013 in Amipur village of Haryana during the Congress' Bhupinder Singh Hooda government, for which Robert Vadra, Hooda and DLF are being investigated by the CBI (c. December 2017). Hooda's generosity towards land sharks and builders caused huge losses to farmers and Haryana Government. Consequently, there are Central Bureau of Investigation (CBI) inquiries and court cases against him related to shady land deals. Those deals include the allotment of a highly subsidised land and change in land use license for his relatives and influential friends connected to Indian National Congress, such Sonia Gandhi's son-in-law Robert Vadra. Vadra made illegal gains of over INR50 crore from this land deal within few months in 2008. CBI has filed an 80,000 page long chargesheet in the court related to this case and Gurugram-Manesar IMT land scam case.

There are a total of 6 CBI cases and several other vigilance department investigations against Hooda underway. Central Bureau of Investigation is investigating several scams, mostly related to illegal land grab, that took place during his rule in Haryana. These investigations include the Gurugram-Manesar IMT land scam, Gurugram Rajiv Gandhi Trust land grab scam, Sonepat-Kharkhoda IMT land scam case, Garhi Sampla Uddar Gagan land scam, Panchkula-HUDA Industrial plots allotment scam, AJL-National Herald Panchkula land grab scam, Haryana Forestry scam case and Haryana Raxil drug purchase scam. He has been already chargesheeted in the Manesar-Gurugram land scam, while other cases are still under investigation (c. March 2018). Hooda was acquiring land from poor, illiterate farmers at a low rate in the name of "public interest" only to later license this to builders after granting out-of-turn favors that helped the land value increase exponentially. During his 10-year rule as Chief Minister, Hooda, licensed a massive 24,825 acres of land compared to just 8,550.32 acres by successive Chief Ministers in the 23 years preceding Hooda rule.

Modus of scam : -

Builders coerce farmers to sell their land by getting the government to use the Section 4 of the land law to have a government notification issued to the farmer that their land is required for the "public purpose". Builders try to acquire this land by offering a small premium above the government's rate for the acquisition of the land. If landowners farmers still resist the sale, then Section 6 of land law is applied by declaring the government's intention to acquire land, which forces the reluctant farmers to sell the land to builders at small premium. Once the land is acquired by the builders, government cancels the acquisition process and releases the land to new build owners, along with the change in land use permission to build residential and industrial building on the farm land. This results in steep rise in the land prices, resulting in massive gains for the builders, opportunity cost loss to the farmers and land tax revenue loss to the government. Robert Vadra and DLF were the beneficiary builders in Hooda's regime.

Vadra made an illegal profit of more than INR50 crore after buying 3 acre land for INR 7 crore and by onselling it to DLF for INR 58 crore after a few months after Hooda's Indian National Congress government had granted a Change in Land Use license to convert its usage from agriculture to commercial. vadra has bought properties using unsecured loans from DLF. After Bharatiya Janata Party (BJP) government came to power in Haryana, the "Justice Dhingra Commission" was formed in 2015 to investigate the scam. Dhings Commission indicted Hooda. Dingra Commission's report states that there was collusion aimed at benefiting Vadra's company Skylight Hospitality, and it sought further inquiry. Consequently, the case was handed over to CBI for the further investigation.

Current status: CBI inquiry

Case is currently under investigation by the CBI, who has filed 80,000 pages long chargesheet in the court.

2. ED summons Robert Vadra in Bikaner land scam case :-

The Enforcement Directorate has summoned Robert Vadra, brother-in-law of Congress president Rahul Gandhi, in connection with its money laundering probe in a land scam case in Rajasthan's border city of Bikaner, officials said on Friday.

They added that Vadra was asked to appear before the investigating officer of the case next week and this was the second summons issued to him for recording his statement under the Prevention of Money Laundering Act.

The officials said that as Vadra did not appear before the investigating officer when the first summons was issued earlier in November, the second summons was issued to him.

The central probe agency had registered a criminal case in connection with the deal in 2015, taking cognisance of a clutch of FIRs and chargesheets filed by the Rajasthan police after the local tehsildar of Bikaner complained about alleged forgery in the allotment of land in the area, considered sensitive due to its proximity to the Indo-Pak border.

The ED, it is understood, wants to grill Vadra about the operations of a firm -- Ms Skylight Hospitality Private Limited -- allegedly linked to him, which had purchased land in the area. It also wants to confront Vadra with the statements of those said to be linked to him.

The agency was also probing the role of a big steel firm that gave loans to a company that bought the land from firms linked to Vadra for a very inflated price, official sources said.

The agency, in the past, had also raided the premises of people linked to Vadra, like Mahesh Nagar and a few others.

In December last year, the ED had arrested Ashok Kumar, a close associate of Nagar, and another person, Jaiprakash Bagarwa.

Nagar is said to be associated with Ms Skylight Hospitality Private Limited, the firm with alleged links to Vadra.

The ED had searched the premises of both Kumar and Nagar in April last year.

Nagar was the "authorised representative" in four cases of land purchase in Bikaner.

Kumar, the agency alleged, had purchased land in the same area, using the "power of attorney" of others.

The ED probe in the case is related to the purchase of a land measuring 275 bigha allegedly by the company in Bikaner's Kolayat area a few years ago.

The agency has also attached assets worth Rs 1.18 crore of government officials and others in connection with the case under the provisions of the PMLA.

The ED, in the past, had also issued notices to the firm and obtained certain documents from it.

The agency, however, has not mentioned Vadra's name in its FIR filed under the PMLA. The FIR names some Rajasthan government officials and the "land mafia".

Vadra had earlier denied any wrongdoing in connection with the land deal and the Congress had claimed that the case was a result of "sheer political vendetta".

The Rajasthan government had, in January 2015, cancelled the mutations (transfer of land) of 374.44 hectares of land, after the land department claimed to have found that the allotments were made in the names of "illegal private persons".

The tehsildar had said in his complaint that the government land in 34 villages of Bikaner, to be used for expanding the Army's firing range in the area, was "grabbed" by the land mafia with the help of "forged and fabricated documents", in connivance with government officials.

The ED suspects that a huge amount of money was laundered in the case as people bought land for cheap through forged documents.

The state government had, while cancelling the mutations, said those were not issued by the Commissioner, Colonisation, Bikaner.


*UNIVERSAL FRAUD

Businessman Robert Vadra, accused in Bikaner land scam deal, on Wednesday said that he would cooperate in the investigation against him and not run away to some other country, adding that the process should be fair and legal. He also said that his premises were ransacked and that his family is stressed and his mother unwell.

Vadra's firm Sunlight Hospitality is implicated in a land-scam case in Bikaner, Rajasthan. According to the Enforcement Directorate (ED), Vadra-owned Skylight Hospitality had purchased 69.55 hectares of land for Rs 72 lakh and then sold it to Allegeny Finlease for Rs 5.15 crore, earning a profit of Rs 4.43 crore. The agency registered a criminal case under the Money Laundering Act in 2015, taking cognizance of a case filed by the Rajasthan Police following forgery allegations in the allotment of land in the area, considered sensitive due to its proximity to the Indo-Pak border.

 ED officials reached Vadra's office in South Delhi's Sukhdev Vihar on Friday evening. Vadra was not present but his team of lawyers met ED officials. They said that the raids were part of a conspiracy to falsely implicate the son-in-law of Congress matriarch Sonia Gandhi.

ED officials clarified that no raids had been conducted on Vadra. "The searches were linked to two employees of Vadra over money-laundering allegations. They are alleged to have acquired assets abroad, allegedly bought using commissions from certain defence deals," they said.

Meanwhile, addressing a press conference in New Delhi, Congress Spokesperson Abhishek Manu Singhvi had said that the raids were 'dirty and malicious tricks' of the Prime Minister Narendra Modi-led BJP government at the Centre. Veteran Congress leader Kapil Sibal also accused the ED of hooliganism.

"There was no FIR, ECIR [Enforcement Case Investigation Report] against Vadra Ji and people of Enforcement Directorate reached his offices without any warrant. They don't say their names and when asked to wait by the people in the office to get keys to the office, they broke into the office," Sibal had said.

Robert Vadra misused the loopholes within Indian banking system.

1. Robert Vadra started around 12 companies within a span of very few years.

2. Then he reached out to public sector banks for overdraft loans on names of these companies.

3.Instead of using any money in these companies, he invested that money in other commodities such as he bought land of 7 crore rupees at Manesar.

4. Then he sold the same land to DLF at 8 times price.

So, he misued the public money which should have been used for development of growth opportunities. He also goofed up with balance sheets of fake companies. This whole scam was done under Congress miniter Hooda, who was in power in Haryana, at that time.

All you need to know about the alleged scam behind Robert Vadra's Haryana land deal

Justice S N Dhingra, who was appointed to probe issues concerning the grant of license(s) for developing commercial colonies in Gurgaon Sector 83 by Haryana’s Department of Town and Country Planning, on Thursday asked for more time to submit the report.

Justice Dhingra, who was meant to submit on Friday a report on whether Robert Vadra, the son-in-law of Congress President Sonia Gandhi, was the beneficiary of a sweetheart deal when her party was in power, said that he needs an extension of six more weeks.

What the allegations are

The alleged scam revolves around Haryana-cadre IAS officer Ashok Khemka, Vadra, and the latter's company.

The company in question is Skylight Hospitality, which bought a 3.5-acre plot in Shikohpur village near Manesar. The same plot was later sold to DLF at a huge profit.

According to a report by Tehelka magazine, the land in question, purchased by Vadra's company for around Rs 7 crore, was sold to DLF for an amount of Rs 58 crore. The report added that in the period between its purchase and sale, the then Bhupinder Singh Hooda-led government in the state granted a Change of Land Use (CLU) permission for the land. Due to the CLU permission, the report said that the value of the plot of land in question shot up sharply.

Alleging various irregularities, Khemka, in late 2012, set aside the mutation of the property sold by Vadra to DLF. However, the then Congress-run state government later gave a clean chit to Vadra.

According to Khemka's report, submitted in May of 2013 in response to a Haryana government committee's clean chit to Vadra, a statement regarding book overdraft in the Skylight balance sheet for the year ended March 2008 was false. “The bank balance is wrongly shown as book overdraft (OD) of Rs 7,94,00,000.”

Further, at serial no. 6 of the Notes To Accounts, the following was indicated: “The OD shown in Corporation Bank account is book OD due to cheque issued before balance sheet date but not presented up to balance date, which is cleared after balance sheet date.”

Khemka said in his report: “This was a false statement.” According to him, the actual and correct position as on March 31, 2008, was that Onkareshwar Properties Pvt Ltd was the creditor of Sky Light Hospitality to the extent of Rs 7.95 crore and the actual bank balance was Rs 1 lakh.

Khemka also said: “The cheque no. 607251, dated February 9, 2008, shown to be paid to M/s Onkareshwar Properties in the registered deed no. 4928 dated 12.2.2008 for Rs 7.5 crore does not belong to M/s Sky Light Hospitality.”

The payment of Rs 7.95 crore was made to Onkareshwar Properties after money was received from DLF Universal Ltd (then known as, DLF Retail Developers Ltd) in the shape of advance or interest-free loan.

With the two documents – land title and Letter of Intent for grant of colony licence – in its possession, it became possible for Sky Light Hospitality to execute a “collaboration agreement” with DLF Retail Developers, which was done on August 5, 2008, and to receive huge amounts as advance or interest-free loan from DLF. According to the balance sheet of Sky Light Hospitality as on March 31, 2009, the company had received advances of Rs 25 crore from the DLF Group towards the joint-venture and land accounts during the year 2008-09.

This funding from the DLF Group was used to clear the dues of Rs 7.95 crore — Rs 7.5 crore towards cost of land plus Rs 45 lakh towards stamp duty, to Onkareshwar Properties, the vendor-company, which sold the land to Sky Light.

The motive of the sham transactions was to corner the huge market premium on account of the commercial colony licence, Khemka alleged.

Clean chit to Vadra in 2012

However, in October of 2012, an enquiry ordered by Khemka to look into alleged undervaluation of registered property by Vadra and his companies in Haryana found no irregularities.

The Hindu quoted an official release saying: “The Deputy Commissioners of Gurgaon, Faridabad, Palwal and Mewat have inspected all the documents registered in their districts from January 1, 2005, till date by or on behalf of Mr. Vadra or his companies in the capacity of either vendor or vendee and have certified that no deed has been found registered as undervalued.”

CAG report digs up the case, raps then Congress-led state government

In its report for the year 2013-14, tabled in the Haryana Assembly in March of 2015, the Comptroller and Auditor General (CAG) came down heavily on the Town and Country Planning Department.

Though the report did not name Vadra, his company, Skylight Hospitality, was named.

The report noted irregularities and alleged that exceptions had been made in the case of the plot owned by Vadra's company.

Subsequently, a one-man commission headed by Justice Dhingra was set up by the Bharatiya Janata Party (BJP) government in Haryana, in May 2015, to probe controversial land deals in Haryana, including Vadra's land deals.

Congress fights back

According to The Times of India, former Haryana minister and Congress MLA Captain Ajay Yadav has accused the BJP of 'bribing' Justice Dhingra.

Yadav, according to the report, was referring to the BJP-led state government sanctioning the building of a road leading to a school being set up by a trust headed by Dhingra in a village in Gurugram.

Vadra, for his part, responded to the latest developments in a Facebook post.

"Almost a decade of governments false and baseless accusations on me! They cannot prove anything without proof, and there is nothing there to prove..." Vadra said.
