New Delhi: State governments have no powers to reject the implementation of the Citizenship (Amendment) Act as the legislation was enacted under the Union List of the 7th Schedule of the Constitution, and the National Population Register which is to be carried out next year, a top official said on Friday.

The statement came after chief ministers of West Bengal, Punjab, Kerala, Madhya Pradesh and Chhattisgarh announced that the CAA was "unconstitutional" and has no place in their respective states. Several others, including BJP ally and Bihar CM Nitish Kumar, have said they would not allow the implementation of NRC in their states.

"The states have no powers to deny implementation of a central law which is in the Union List," the Home Ministry official said.

There are 97 items under the Union List of the 7th Schedule and they include Defence, External Affairs, Railways, Citizenship and Naturalisation.

Referring to NPR, which will be carried out along with the census exercise next year, the official said no state can refuse to carry out the process as it will be done as per the Citizenship Act.

The NPR is a register of usual residents of the country. It is being prepared at the local (village/sub-town), sub-district, district, state and national level under provisions of the Citizenship Act, 1955 and the Citizenship (Registration of Citizens and issue of National Identity Cards) Rules, 2003.

It is mandatory for every usual resident of India to register in the NPR.

A usual resident is defined for the purposes of NPR as a person who has resided in a local area for the past 6 months or more or a person who intends to reside in that area for the next 6 months or more.

Last week, Kerala Chief Minister Pinarayi Vijayan said "an anti-constitutional law (CAA) will have no place" in his state.

Bengal Chief Minister Mamata Banerjee said, "In your (BJP) manifesto, instead of development issues, you have put in promise to divide the country. Why will citizenship be on the basis of religion? I will not accept this. We dare you".

"You can pass laws in Lok Sabha and Rajya Sabha forcefully because you have the number. But we will not let you divide the country," she said.

Banerjee also announced that her government will not allow NPR exercise in Bengal as it would help the government identify ‘doubtful’ citizens and in turn create a NRC.

Describing CAA as a "direct assault" on India's secular character, Punjab Chief Minister Amarinder Singh said his government will not let the legislation be implemented in his state.

"We have a majority in the assembly and we will block the bill," Singh said.

According to the amended Citizenship Act, members of Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who have come from Pakistan, Bangladesh and Afghanistan till December 31, 2014 and faced religious persecution there will not be treated as illegal immigrants and given Indian citizenship.

The CAA says the refugees of the six communities will be given Indian citizenship after residing in India for five years, instead of 11 years earlier.

Chhattisgarh Chief Minister Bhupesh Baghel said the act was clearly unconstitutional. "Whatever decision is made at the Congress party forum on the bill, will be applied in Chhattisgarh," he said.

The act also proposes to give immunity to such refugees facing legal cases after being found as illegal migrants.

Madhya Pradesh Chief Minister Kamal Nath said, "Whatever stand the Congress party has taken on Citizenship Amendment Act, we will follow that. Do we want to be a part of a process that sows seeds of divisiveness?".

Senior Congress leader P Chidambaram also said the bill was a "brazen assault" on the fundamental ideas enshrined in the Constitution and the fate of the law will be decided in the Supreme Court.

The Citizenship (Amendment) Bill was passed by both houses of Parliament last week and has received the presidential assent.

A petition has been filed in the Supreme Court seeking implementation of Citizenship Amendment Act, 2019 (CAA) and for action against those who caused damage to life and property, and the parties who allegedly instigated them, in light of the ongoing protests that broke out against CAA.

The petitioner, who describes herself as a citizen who is concerned over the loss of lives and damage to property across the country, has also urged the top court to declare the CAA constitutional and further direct it to be implemented "aggressively" in all states.

Filed through advocate Vineet Dhanda, the petition alleges that the protests, that have been on throughout the country, are politically motivated by parties who are out of power and is as a result of their vendetta against the central government. It is further alleged that wrong information has been spread by such political persons, which in turn has created a sense of terror and concern in the minds of the Muslim community. The petitioner accuses 'political persons' of conspiring against the government and creating an environment of fear and violence because of their own political agenda, which has essentially led to the loss of around 50 lives and hundreds of crores in public property. Beyond this, urges the petitioner, the country has been brought to disrepute as a result of these events and that is a "gross violation of Article 111" of the Constitution.

"Political persons belonging to various political parties across India started misguiding and spreading false rumors and hereby creating a sense of terror and concern in the minds of community belonging to Muslim people across the country. The political persons belonging to various political parties which are out of power hatched a conspiracy against the government."

"Political persons with a vendetta against the government and its progressive approach have created an environment of hatred, fear, violence in various parts of the country for their vested political interest as a result of which around 50 precious lives have been lost in various parts of the country and public property worth hundreds of crores has been destroyed. The negative environment of fear and violence has resulted not only in the loss of precious lives, damage to public property but also has caused huge economic loss across the country and has also bought a bad name to our country."

The petitioner goes on to specify that the 'false rumours and fear' were initially spread from Delhi through 'an MLA' and then alleges that other political parties provoked the students of "Jamia Millia Islamia University to create disturbance in the city of Delhi." Further naming JawaharLal Nehru University, the petitioner says that it is now fashionable for students to take an anti-India stand, which is capitalized upon by political parties and 'urban naxalites' to carry out anti-national activities.

"Be it abusing the Hon'ble Supreme Court Judges after Yakub Memon's hanging or hanging of Afzal Guru by part of the students of Jamia Millia Islamia University and Jawahar Lal Nehru University to full blown fight with police after Citizenship Amendment Act was passed, Anti-India stand has become fashion of many students belonging to these institutions who otherwise are famous for the achievement of their legendry students. The students belonging to these institutions are provoked into violence and Anti-India activities by various out of power political parties and urban Naxalites who are dead against the development of our country."

Citing a number of articles from various organisations, the petitioner submits that she decided to approach the apex court for an efficacious remedy in light of the violence in "states like Assam, Haryana, Maharashtra, Telangana, Uttar Pradesh, Delhi and other parts of the country."

In addition to her concern regarding the violence, the petitioner also raised grounds for declaring CAA constitutional and sought for its implementation across the country. It has been submitted that the Act purports to protect minorities in three countries where such minorities are subjected to brutalities by the majority, and it is the duty of our country to, therefore, save them. Given the intent of the amendment, the petitioner also submits that it would not affect the Muslim community in India in any way.

"It is the prime duty of our country to save these minority communities of Afghanistan, Pakistan, Bangladesh from being brutalized, killed, converted, raped by the majority community of these countries. With an aim to save the above mentioned innocent minorities, the citizenship amendment Act has been passed."

In her prayer, the petitioner has asked the court to also direct the Central government to widely advertise information about CAA so as to clarify that it is not against the spirit of the Constitution or against any citizen. In addition, the petitioner also pleas for a direction to the Information and Broadcasting Ministry to act against media houses spreading false information, and also for a direction to Election Commission of India to track political parties spreading rumours and act against them.

Since the Supreme Court is currently closed due to the winter vacations, it is expected that an urgent hearing will be sought as nationwide protests against the CAA continue.

For centuries, India has welcomed visitors and refugees who brought with them their rich culture, languages, and traditions. Indians always preached universal love and peace for the universal family. Since ages, India has advocated Vasudhaiva Kutumbakam — that the entire earth is one family. Across the world, Indians are known for their extraordinary ability to assimilate different cultures and values.

After the British finally left the Subcontinent in 1947, India was partitioned into two independent nation-states: Hindu-majority India and Muslim-majority Pakistan. This was followed by one of the greatest and most painful migrations in human history. Millions of Muslims trekked to West and East Pakistan (Bangladesh) while lakhs of Hindus and Sikhs headed in the opposite direction.

Uncertain about their future, hundreds of thousands never made it to their final destination. Prime Minister Narendra Modi has expressed the sentiments and basic spirit behind the Citizenship Amendment Act: “Citizenship Amendment Bill is not a favour; this Act will protect the interests of those who believe in Mother India.” The motive of this Act is to help minority groups who have come to escape persecution in Pakistan, Afghanistan, and Bangladesh, which are Muslim-majority nations.

Mahatma Gandhi, Pattabhi Sitaramayya, J B Kripalani, Abul Kalam Azad and Syama Prasad Mookerjee or Tridip Chaudhuri — they all wanted refugees to be provided shelter with respect. The CAA seeks to help oppressed illegal immigrants belonging to Hindu, Sikh, Parsi, Buddhist and Christian religions from Pakistan, Afghanistan and Bangladesh, who were forced to flee to India and have lived in India without documentation. In these cases, the standard eligibility criteria for citizenship — 11 years of residence in India — has been relaxed. Shah has rightly pointed out that the CAA would not have been necessary had the country not faced Partition based on religion. He further said that this law will bring a new dawn in the lives of crores of people.

It must be asserted strongly that all protests should be scrupulously peaceful and any attempt to damage public property or public servants is unacceptable. There are allegations that the CAA violates constitutional provisions. There are arguments that this Act will facilitate a huge influx of illegal migrants and that illegal migrants will be given citizenship retrospectively. India is a democratic country that ensures fundamental rights to its citizens conferred on them by the Constitution. No statute, including the CAA, can take these away. Certain anti-social elements are spearheading a misinformation campaign.

The northeastern states, in particular, are being targeted to spread this false propaganda. A vicious campaign involving students has been launched to label this Act as anti-Muslim.

The CAA does not affect any Indian citizens, including Muslims. We have to understand that the CAA has no role in the deportation of any foreigner. The process of deportation takes place as per the mandate of the Foreigners Act, 1946 and/or The Passport (Entry into India) Act, 1920. In any case, deportation is a judicial process based on inquiries conducted by law enforcement agencies. The home minister has reiterated that the interest of northeastern states will be safeguarded under the Sixth Schedule to the Constitution and the statutory protection given to areas covered under the “Inner Line” system of the Bengal Eastern Frontier Regulation, 1873.

We do understand that voicing concern, protest, dissent are inherent to the democratic setup but causing damage to public property and indulging in violence is unacceptable. To uphold the secular and democratic the fabric of the country, we should only use democratic forums to express our difference of opinion.

It is heartening that a group of academics, intellectuals, and research scholars have come out in support of the CAA. In a statement issued by over 1,100 academics from all over the country, it was pointed that the CAA is in perfect sync with the constitutional values of India as it does not debar anyone seeking citizenship based on religion. The support not only came from premiere institutes like IITs and IIMs, Jawaharlal Nehru University, Delhi University, All India Institute of Medical Sciences but also from various international institutions including Princeton University, Oxford, Politecnico di Milano-Milan, the University of Warwick and Imperial College London. The signatories have expressed their complete satisfaction with the way the concerns of the Northeast states have been handled.

Concerns are being raised from different quarters about the violation of Article 14 that guarantees equality and equal protection of law to everyone. We must understand that the CAA proposes to help people under distress. Oppressed minorities are being helped under special circumstances.

As per data obtained from various sources, the minority population has dwindled substantially in Pakistan and Bangladesh. Now, the question is: What happened to the minority Hindu population? Right from the beginning, they faced oppression and because of this, they were forced to flee to India. This speaks volumes about the great failure of Nehru-Liaquat pact.

Thanking all those who supported this important law, the PM said that the CAA is in complete alignment with India’s centuries-old ethos and a strong belief in humanitarian values. India has always supported the oppressed, helpless and persecuted people. So, what is new in this Act? India is India because of its rich cultural heritage and its ethos. This Act is about sharing the pain of our brothers and sisters who were forced to move out of their respective countries.

Though the one-day special session was convened to ratify the extension of the reservation for SC and ST in the Assembly and the Parliament for another decade, the resolution against CAA was also taken up in view of the the widespread concerns among public in this regard, official sources said.

While presenting the resolution, Vijayan said the CAA was against the "secular" outlook and fabric of the country and would lead to religion- based discrimination in granting citizenship.

"The Act contradicts the basic values and principles of the Constitution. In view of the anxiety among the people of the country, the Centre should take steps to drop the CAA and uphold the secular outlook of the Constitution," he said.

Noting that the Act had triggered widespread protests among various stratas of society, the Chief Minister said it had dented India's image in front of the international community.

Vijayan also ensured the Assembly that there wont be any detention centres in the southern state.

When the session began, O Rajagopal, the lone BJP member in the Assembly, objected to the resolution stating that it was "illegal" as both Houses of the Parliament had passed the CAA Act.

The Opposition Congress -led UDF had demanded the Left government to convene a special session and pass a resolution against the CAA during an all-party meeting convened by the Chief Minister on December 29 to discuss the issue.

The Vice President of India, Shri M Venkaiah Naidu has called for an enlightened and constructive debate on issues such as CAA, NRC and NPR and urged the people to study in-depth and fully understand the background before reacting to any issue.

Inaugurating the Birth Centenary Celebrations of the late Chief Minister of united Andhra Pradesh, Dr. M. Channa Reddy in Hyderabad, the Vice President said that violence and democracy do not go together and cautioned the people to not get carried away in this age of fake news.

As regards CAA, NRC and NPR, the people of the country should have an enlightened, meaningful and constructive discussion and not jump to hasty conclusions. Ours is a mature democracy and there is no place for violence in it, the Vice President stressed.

Stating that dissent or disagreement has to be expressed in a constructive, democratic and peaceful manner, he recalled that Mahatma Gandhi had eschewed violence in all its forms even in the face of most daunting challenges. “While protesting against the British rule, he remained civil even to his adversary. He called off Non Cooperation Movement after Chauri Chaura incident which had turned violent”, he pointed out.

The Vice President stressed the need for maintaining the dignity of Parliament and Legislatures and raising the standards of the debates. He said that personal attacks should not be made, while policies could be criticized.

Referring to the governance system, the Vice President called for reforming it constantly in tune with people’s aspirations. He emphasized that transparency, accountability and people-centric policies were essential to provide good governance.

He said that eliminating corruption, decentralizing administration, cutting down red tape, promoting online interface between government departments and the public and promptly addressing the grievances were important features of a responsive administration.

Paying rich tributes to Dr. Channa Reddy, he said the late Chief Minister was a grass-roots politician and a mass leader, who relentlessly strove to uplift the conditions of the common people. The fact that he had occupied so many high offices is a testimony to his administrative acumen and leadership qualities, he added.

The Vice President said that Dr. Reddy’s tenure as Chief Minister was marked by many developmental initiatives as he steered the State on the path to industrialization. He toned up the administration by cutting on red tape and simplifying procedures.

Recalling that agriculture was close to Dr. Reddy’s heart, the Vice President said that he had accorded the highest priority to improving the lot of the farmers.

He also stated that the late Chief Minister was a relentless champion of social justice and had introduced reservations for BCs in government jobs and education in 1980. As a firm believer in strengthening democratic foundations, he reduced the voting age for local bodies from 21 years to 18 years, the Vice President added.

The Vice President also conferred Dr. M. Channa Reddy National Award for Sustainable Development posthumously on eminent irrigation expert Late Shri T Hanumantha Rao. The award is in recognition of his revolutionary innovation of Four Water Concept (FWC) for watershed development.

Shri Bandaru Dattatreya, Honorable Governor of Himachal Pradesh, Dr. K. Rosaiah, honorable former Governor of Tamil Nadu and others were present on the occasion.


The following is the full text of the speech:

I am pleased to be here to inaugurate the Centenary Celebrations of Dr. Marri Channa Reddy Garu, who had served the nation with distinction in various capacities. He was a visionary in the true sense and was gifted with remarkable administrative acumen.

Perhaps, he was one of the few leaders, who had served as Governor of four States, Chief Minister on two occasions and as a Union Minister. The fact that he had occupied so many high offices is a testimony to his administrative acumen and leadership qualities.

Indeed, Dr. Reddy was a grass-roots politician and a mass leader, who relentlessly strove to uplift the conditions of the common people. He was quick to grasp people’s problems and understand their aspirations. As a result, he used to give shape to policies that addressed their concerns.

Hailing from a farmer’s family, agriculture was close to his heart. He accorded the highest priority to improving the lot of the farmers and focused on agriculture in view of the primacy it deserves in our society.

He always had his finger on the pulse of the people and the fact that he served as Chief Minister of the erstwhile united Andhra Pradesh on two occasions in 1978 and 1989 showed how popular he was. A powerful orator in Telugu, Urdu, Hindi and English and a people’s man to the end, Dr. Reddy struck a special chord with the people of united Andhra Pradesh.

Dr. Channa Reddy began his journey in the service of the country in his early twenties after giving up his medical practice and plunging into the freedom struggle. To this day, he is remembered for his powerful writings in the Telugu weekly, "Hyderabad" which he ran from Vijayawada during the struggle against the Nizam's rule in erstwhile Hyderabad.

At the age of 31, he became the youngest member of the Provisional Parliament in 1950. He was inducted as a minister in the Cabinet of Shri Boorgula Ramakrishna Rao.

His tenure as Chief Minister of the erstwhile united Andhra Pradesh was marked by many developmental initiatives as he steered the State on the path to industrialization, even as he ensured that the state’s development was not at the cost of agriculture. He toned up the administration by cutting on red tape and simplifying procedures.

He also took steps to improve land administration and set up Land Development Councils.

He was a relentless champion of social justice and had introduced reservations for BCs in government jobs and education in 1980. As a firm believer in strengthening democratic foundations, he reduced the voting age for local bodies from 21 years to 18 years.

For the benefit of farmers, he introduced a scheme to provide subsidies on fertilizers and seeds. He reduced interest on agricultural credit and accorded top priority for creating irrigation facilities.

He exempted land revenue for small farmers having holdings of 2.5 acres wet and 5 acres dry land and conferred right of land to about 75,000 people by distributing 1.33 lakh acres.

In a bid to address the problem of unemployed youth, the Society for Employment Promotion and Training in Twin Cities (SETWIN) was established when Dr. Reddy was the Chief Minister.

During his second stint as Chief Minister, Remote Area Development programme was launched in some of the naxalite-affected backward districts to wean away youth from the influence of the radicals. He will be always remembered for implementing the World Bank-assisted Cyclone Emergency Reconstruction Project and for taking up modernization of irrigation structures in Krishna and Godavari delta regions.

As Union Minister for Steel, he introduced reforms to improve steel production and brought about decontrol of distribution of steel and coal.

As a young MLA, I used to vehemently criticize his government’s decisions in the Assembly. One of his great qualities was that he never held anything against even his most bitter critic. Always a keen listener, he used to reply to every point raised by me or other opposition members.

I had the opportunity to interact with him on several occasions and what struck me was his concern to address the people’s problems. I also found him to be a man of strong convictions and principles.

Dr. Reddy was known as a firebrand leader and had championed the cause of a separate Telangana State in the late sixties. It led the government to provide key safeguards, mainly in terms employment and education, to the people of Telangana.

As we recall the excellent administrative qualities of Dr. Channa Reddy and pay tributes to him, we need to understand the importance of constantly reforming our governance system in tune with the needs and aspirations of the people. Transparency, accountability and people-centric policies are essential to provide good governance.

Eliminating corruption, decentralizing administration, cutting down red tape, promoting online interface between government departments and the public and promptly addressing the grievances are important features of a responsive administration.

Before concluding, let me stress the need for an enlightened debate on any issue before reacting to it. In this age of fake news, one should be all the more cautious before reacting. As a matter-of-fact, one should first understand and study the issue in-depth, know its background and try to know what will be its impact. We need to focus on the issue rather than diverting from the main issue.

As regards CAA, NRC and NPC, the people of the country should have an enlightened, meaningful and constructive discussion and not jump to hasty conclusions either way.

We are an independent country and a mature democracy. It should be remembered that violence and democracy will not go together. Any dissent or disagreement has to be expressed in a constructive, democratic and peaceful manner. Apprehensions need to be answered and addressed by the government at every level.

Please remember that the Father of the Nation, Mahatma Gandhi eschewed violence in all its forms even in the face of most daunting challenges. His methods of protest were scrupulously non-violent. While protesting against the British rule, he remained civil even to his adversary. He called off Non Cooperation Movement after Chauri Chaura incident which had turned violent.

Gandhi Ji continues to inspire the humanity with his eternal values, powerful ideas and thoughtful actions based on truth and non-violence. As we are observing the 150th Jayanthi of Gandhi Ji, it is all the more important for us to remember that his views and the message of his life are eternal.

Finally, let me thank the organizers for inviting me to inaugurate the centenary celebrations of Dr. Channa Reddy Garu. He was a great son of this soil and left an indelible mark on the Indian political scene.
