“On the strong foundation of separation of power, we have to pave the path of collective responsibility, create a roadmap, determine goals and take the country to its destination”

Prime Minister Shri Narendra Modi addressed the Constitution Day Celebrations organized by the Supreme Court here today. Chief Justice of India Shri Justice NV Ramana, Union Minister Shri Kiren Rijuju, Senior Supreme Court and High Court Justices, Attorney General of India Shri K K Venugopal and President of Supreme Court Bar Association Shri Vikas Singh were among those present on the occasion.

Addressing the gathering, the Prime Minister said in the morning he was amidst the colleagues from the legislature and the executive. And now he was among all the learned members of the judiciary. “We all may have different roles, different responsibilities, different ways of working, but the source of our faith, inspiration and energy is the same – our Constitution”, the Prime Minister emphasized.

The Prime Minister said that our constitution makers gave us the constitution cherishing the great tradition of India of  thousands of years and  in the light of the dreams of the people who lived and died for freedom.

The Prime Minister stressed that even after so many years of independence, a large chunk of the citizens were condemned to suffer exclusion in the areas of basic needs like drinking water, toilets, electricity etc. Working to make their life easier is the best tribute to the constitution. He expressed satisfaction that a massive campaign to turn this exclusion into conclusion is underway in the country.

During the Corona period, the Prime Minister said, free food grains were provided to more than 80 crore people for the last several months. The government is giving free food grains to the poor by spending more than Rs 2 lakh 60 thousand crore on PM Garib Kalyan Anna Yojana. He added that this scheme was extended yesterday till March next year. He said when the needs and concerns of the poor, women, transgenders, street vendors, divyangs and other segments get addressed, they get included  in the process of nation-building and their faith in the constitution gets strengthened.

The Prime Minister remarked that Sabka Saath-Sabka Vikas, Sabka Vishwas-Sabka Prayas, is the most powerful manifestation of the spirit of the Constitution. Government dedicated to the Constitution, does not discriminate in development and we have done this. Today the poorest of the poor are getting the same access to quality infrastructure, which was once limited to the resourceful people. Today, the country has as much focus on the development of Ladakh, Andaman and North East as it is on metro cities like Delhi and Mumbai, he said.

Referring to recently released results of National Family Health Survey, the Prime Minister said that with regard to gender equality, now the number of daughters is increasing in comparison to men. More opportunities for hospital delivery are becoming available to pregnant women. Due to this the maternal mortality rate, infant mortality rate are decreasing.

The Prime Minister said today there is no country in the whole world that apparently exists as a colony of another country. But this does not mean that the colonial mindset too is over. “We are seeing that this mindset is giving rise to many distortions. The most obvious example of this is seen in the obstacles faced by us in the development journey of developing countries. Efforts are being made to close the same means, the same path, for the developing countries, by the means by which the developed world has reached today’s position”,he said. The Prime Minister noted that India is the only country in the process of achieving the goals of the Paris Agreement ahead of time. And yet, in the name of environment, various pressures are created on India. All this is the result of a colonial mentality. He said “unfortunately due to such a mentality, obstacles are put in the development of our own country. Sometimes in the name of freedom of expression and sometimes with the help of something else”, he emphasized. He added that this colonial mindset is a big obstacle in further strengthening the determination that was created in the freedom movement. “We have to remove it. And for this, our biggest strength, our biggest inspiration, is our Constitution”, he said.

The Prime Minister remarked that both the government and the judiciary are born out of the womb of the Constitution. Hence, both are twins. These two have come into existence only because of the constitution. So, from a broader point of view, the two complement each other even while being different. He underlined the importance of the concept of separation of power and said that, in the Amrit Kaal, there is need to show collective resolve within the spirit of the Constitution  as the common man deserves more than what he has currently. “On the strong foundation of separation of power, we have to pave the path of collective responsibility, create a roadmap, determine goals and take the country to its destination”, He added.

2.##Undemocratic, family-run party system is not in tune with the Constitution: PM Modi : Nov 26, 2021 : Shishir Gupta : Hindistan Times : Media Report.

=======================================================================

Prime Minister Narendra Modi on Friday gave three key messages to people, particularly the political parties who are expected to be custodians of the Constitution – shun the family-run party system to become real champions of democracy, don’t revere convicted politicians in public life, and focus on duties to the nation before exerting your rights.

While the first message is directed to key political families across the spectrum such as Gandhis’ stronghold on the Congress, Mamata Banerjee and his nephew’s dominance in the Trinamool Congress (TMC), Mulayam Singh Yadavs’ family-run Samajwadi Party (SP) and Lalu Prasad Yadav’s RJD; his second tirade was at public honouring of Lalu after being convicted in the fodder scam.

Making his third point at the Constitution Day celebrations in the Parliament, the Prime Minister said Mahatma Gandhi had tried to prepare the nation for the duties, even while fighting for the rights in the freedom movement. “It would have been better if the duty had been emphasised after the country's independence. In the Azadi ka Amrit Mahotsav, it is necessary for us to move forward on the path of duty so that our rights are protected,” he said. He was hinted at the leadership post-Independence that promoted “rights” but did not pay adequate attention to “duties” towards the people and the nation.

He said that the political parties are responsible for enforcing democratic traditions, but unfortunately, many of them have no internal democracy because they promote family members instead of merit. “In the form of family-based parties, India is heading towards a kind of a crisis, which is a matter of concern for the people devoted to the Constitution,” he said.

“How can the parties which have lost their democratic character protect democracy?,” he added.

The Prime Minister also warned against the tendency of forgetting and glorifying convicted corrupt people. He said while giving an opportunity to reform we should refrain from glorifying such people in public life.

Prime Minister Narendra Modi was speaking at the “Constitution Day” celebrations in Parliament. The event was also addressed by the President, the Vice President, and the Lok Sabha Speaker.

PM emphasized that November 26 is the day to bow to this house of democracy also. The Prime Ministers bowed to the martyrs of 26/11 also. “Today, 26/11 is such a sad day for us, when the enemies of the country came inside the country and carried out the terrorist attack in Mumbai. The brave soldiers of the country sacrificed their lives while fighting the terrorists. Today I bow to their sacrifices”, he said.

The Prime Minister noted that our constitution is not just a collection of many articles, our constitution is a great tradition of millennia. This is a modern expression of that unbroken stream. The Prime Minister said Constitution Day should also be celebrated because our path should constantly be evaluated whether it is right or not.

Elaborating on the spirit behind celebrating the ‘Constitution Day’, the Prime Minister said it was during the 125th birth anniversary of Babasaheb Ambedkar, “We all felt that what could be a greater auspicious occasion than the gift that Babasaheb Ambedkar had given to this country, we should always remember his contribution in the form of a memory book (Smrit Granth)”.

He said it would have been better if along with establishing the tradition of Republic Day on 26th January, ‘Constitution Day’ was also established on 26th November at that time itself.

3.###KERALA NEGATIVE : Kerala Dalit IPS officer who refused to implicate RSS workers in Fazal murder case and acted against CPM’s directives now working as security guard, denied pension : Nov 26, 2021 : Organiser : Media Report.

=======================================================================

#Kerala Dalit IPS officer who refused to implicate RSS workers in Fazal murder case and acted against CPM’s directives now working as security guard, denied pension

========================================================================

DySP K Radhakrishnan, a retired Kerala IPS officer is struggling to support his family. The crime he did was move ahead with a fair investigation in the Fazal murder case against the wishes of CPM party bosses. He had allegedly been suspended from service for four-and-a-half years, tortured mentally and physically and was denied retirement and pension benefits, and is forced to live in exile in a neighbouring state.

Radhakrishnan was serving as the DySP at the District Crime Records Bureau in Kannur when Mohammed Fazal, who left the CPM and joined NDF, was hacked to death by a gang on October 22, 2006

“They will kill me any time. I am prepared to accept my destiny. But I want to ensure the safety of my children before that,” K Radhakrishnan told the New Indian Express. “My daughter, who is a research scholar has opted for part-time research as we cannot afford her hostel expenses. My son who is a postgraduate had to drop out of the civil service coaching course. I had to sell my family property to fight the case and my house was auctioned by the bank as I defaulted on loan repayment,” he added.

“The very next day of Fazal murder, the CPM had held a protest meeting where area secretary Karayi Rajan named four RSS workers who, he claimed, were involved in the murder. I detained all of them, recorded their statements and tracked all their activities before and after the incident. On day 2, home minister Kodiyeri Balakrishnan summoned me to Payyambalam Guest House and directed me to file the chargesheet within seven days. As I was convinced that the RSS men were not involved in the murder, I released them which antagonised the CPM leadership,” said Radhakrishnan.

Fazal murder case: A heinous case of CPM sponsored murder and misuse of state machinery to implicate RSS workers

A former member of CPM, who later joined NDF, 30-year-old Mohammed Fazal, was hacked to death in Kerala's Thalassery in 2006. The State Crime Branch initially investigated the murder case and later handed it over to the CBI following the direction of the High Court on a writ petition filed by Mariyu, Fazal's wife.

During the investigation by Kerala police, CPM tried to implicate RSS-BJP workers in this murder. But the transfer of this case to the CBI was a huge setback to the party.

The murder happened on October 22 2006. On the very same day, the CPM leader and the then home minister of Kerala Kodiyeri Balakrishnan rushed to the spot and, with no investigation, declared that RSS workers were behind the murder. At 10 AM, a peace meeting was called, and the NDF unilaterally accused RSS of the murder. Sensing a larger conspiracy to malign its image, RSS called for an impartial investigation.

DYSP Radhakrishnan started the investigation on October 23 and took 3 CPM workers to custody for questioning on October 25. On the same day, Kodiyeri ordered the transfer of the investigation from DYSP Radhakrishnan. Later, the police officer was attacked by the CPM goons, and he was under treatment for a long time. On October 30, the case was transferred to the crime branch.

Fazal's wife went to the Kerala High Court for a CBI inquiry on February 4 2007. But on February 12, the case was disposed of after the police assured that the culprits would be arrested soon. On 2007 April 11, Crime Branch SP Rajmohan took over the investigation and arrested three CPM goons, 1) Kodi Suni, 2) Biju, and 3) Jitesh.

Again Fazal's wife filed a petition at the Kerala High Court seeking a CBI enquiry on February 14 2008. CPM filed an appeal against this in the division bench but got rejected. Later, the Supreme Court also ordered a CBI inquiry on July 6, 2010. Later, the CBI added three more people to the list of culprits, and they were 4) Arundas, 5) Kalesh, and 6) Arunkumar. Local CPM is secretary Karayi Rajan, and Local Secretary Karayi Chandrasekharan was also booked under section 120 for conspiring to murder.

The CPM had feared that after Fasal's exit from the party, more Muslim youth would leave CPM. With his murder, the CPM expected a win-win situation, and the blame would be shifted to the RSS, and more Muslim youth could be inducted to CPM.

After CPM leaders got involved in the case, the party started to use their propaganda machinery. The party appointed two DYSPs, 1) Sadanandan and 2)Prince Abraham, to create fake evidence. The police, along with CPM goons, tortured a BJP worker and made his confession statement. But later, the confession was proven to be bogus.

In the report submitted by the CBI, it is pointed that the allegation against the RSS was "not right" and backed its initial probe report, which indicated the involvement of CPI (M) leaders. The CBI report also says that the revelation made by Subheesh in police custody was a forced one.

Subheesh had reportedly confessed to the police that RSS functionaries, including himself, murdered Fazal. Later, Subeesh had retracted from the statement and alleged the police tortured him into confessing.

While commenting on the CBI report, Prajna Pravah National Convenor J Nandakumar said, "Left Govt is using investigative agencies for political vendetta. It's nothing but fascist character of communist regime for which state machinery is an instrument to target political opponents. Fazal case is a classic example of Communist manipulation."

"Under the left govt of Kerala, the state police have lost their credibility. The findings of CBI have given substance to the allegations that a CPM fraction is functioning inside state police force. Politicisation of independent govt agencies by Communists must be opposed at any cost as it poses severe threat to democracy and our constitutional rights. The judiciary and central govt must ensure that Communists don't misuse state power and hijack state institutions and agencies," he added.

The Fazal Murder case is a classic example of CPM using its party system to terminate its political opponents and using government machinery to implicate other party members of the same crimes.

End.

=====================================================================

A former IPS officer named K Radhakrishnan has recalled how he was harassed and humiliated by the CPM government and politicians for not obeying the party’s instructions regarding investigations in a murder case. In a report by the New Indian Express, Radhakrishnan has revealed how he was misbehaved by the Chief Minister too when he went to meet him.

As per the NIE report, K Radhakrishnan, a former IPS officer in Kerala, was suspended from his post in 2006 for not toeing the CPM lines in the investigation of the Muhammad Fazal murder case. The Dalit officer was reportedly falsely implicated in a case, and suspended for two years.

Was asked by CPM leaders to frame RSS people for murder

As per reports, Radhakrishnan was serving as the Deputy SP at the District Crime Records Bureau in Kannur when Mohammed Fazal, who left the CPM and joined NDF, was murdered by a gang on October 22, 2006.

He stated further, “The very next day of Fazal murder, the CPM had held a protest meeting where area secretary Karayi Rajan named four RSS workers who, he claimed, were involved in the murder. I detained all of them, recorded their statements and tracked all their activities before and after the incident. On day 2, home minister Kodiyeri Balakrishnan summoned me to Payyambalam Guest House and directed me to file the charge sheet within seven days. As I was convinced that the RSS men were not involved in the murder, I released them which antagonised the CPM leadership,”

Organiser had reported that Radhakrishnan had taken some CPM men into custody for the murder, but he was attacked by CPM goons and had to be hospitalised. In the meanwhile, the case was transferred to Crime Branch. The Crime Branch had arrested 3 CPM members for the crime. After Fazal’s wife moved to High Court seeking a CBI inquiry, 4 more people, and local CPM leaders were booked for murder conspiracy. CBI had found that the allegations against RSS were wrong.

Suspended, then suspended again

Radhakrishnan, a native of Thalayolaparambu in Kottayam district, has stated, “People from my community rarely get such key posts. My ordeal proves that the scourge of caste discrimination and untouchability still continues in our society. People prefer to keep us away from the corridors of power.”

The officer has further stated that he was again suspended in 2016 over a complaint filed by a Joint Excise Commissioner saying that he submitted a false report against the officer before the High Court. Radhakrishnan was suspended for four and half years this time and was mentally harassed by government functionaries and politicians.

Radhakrishnan went to the Central Administrative Tribunal and later the Supreme Court to fight against the suspension order. Even after his suspension was revoked, he had to file a contempt of court case to finally make the Kerala government reinstate him.

CM Vijayan behaved in a rude manner

Radhakrishanan further explained that the reinstatement brought little respite for him because there were gaps in his service period. He was denied the salary for the period of suspension. A day before his retirement in 2021, he was again served 2 memos. One was regarding an alleged case of custodial torture in 2004 and another was related to the same complaint by the JEC that had got him suspended.

Radhakrishnan stated that the JEC had favoured an accused in a narcotics case and his investigation had proven him wrong. He added that the Central Administrative Tribunal had regularised his suspension period in July 2021. He states that despite that, his pleas for a provisional pension have been rejected mercilessly.

Radhakrishnan explained that he had once gone to meet CM Vijayan in 2018 in his office. He had explained his ordeal to the CM and had requested him to revoke his suspension. He had pleaded that his financial resources have dried up and he needs his salary that had been blocked by the government. He had told that if the government did not release his salary, he would have no other way but to commit suicide along with his family. To his surprise, the CM said, So be it.”

“I walked from the CM’s chamber with a heavy heart. Tears were rolling down my cheeks. I collapsed on a chair in the corridor as I was feeling giddy.”

Former IPS now works as a security officer in private company

 The New Indian Express has reported that the former IPS now works as a security officer in a private company in another state. His daughter, a research scholar, now has to work part-time in her institution because the family cannot afford her hostel fees. His son has dropped out of the coaching institute where he was trying to prepare for civil services. The family have sold their ancestral property to meet expenses. A house they had lived in was reportedly auctioned by the bank because they had defaulted on loan payments.

They will kill me anytime, he said, met with an accident on 26 November

Speaking to The New Indian Express, K Radhakrishnan has stated that by speaking against the CPM, he has become a target. “They will kill me any time. I am prepared to accept my destiny. But I want to ensure the safety of my children before that,” he had stated to the news outlet on November 25.

On 26 November, TNIE journalist Raam Das shared that K Radhakrishnan has been injured in a road accident in Kochi. He has been admitted to the hospital.
